The Office of the Solicitor General prosecutes all traffic violations in the State Court of Habersham County located on the second floor of the Habersham County Courthouse.
Many fines for traffic citations may be paid before the arraignment date shown on the citation. Tickets may be paid in the Clerk of Superior Court's Office, first floor, Habersham County Courthouse.
In some situations, traffic recipients must appear before the Judge, as follows:
Assigned court dates are rescheduled only under extreme circumstances, such as the death or hospitalization of an immediate family member. If there is a possiblity that a scheduled court date will be missed, the Clerk of State Court and/or Solicitor General's Office must be contacted as far in advance of the court date as possible. If the court date is missed, a Bench Warrant will be issued for arrest.
Sentence Guidelines for Misdemeanors
General Misdemeanors: Up to 12 months in jail and/or up to $1,000 find and/or community service
High & Aggravated Misdemeanors: Up to 12 months in jail and/or up to $5,000 fine and/or community service
Some misdemeanor offenses have minimum community service requirements as determined by the Official Code of Georgia Annotated. Furthermore, a defendant may be placed on supervised probation to complete the terms of his/her sentence.
